TERMS OF SERVICE

These Terms of Service govern your use of the Trees and Plants Landscaping Services website and your interactions with Trees and Plants Landscaping Services, referred to in these Terms as “Trees and Plants,” “we,” “us,” or “our.” By visiting our website, submitting a request, requesting an estimate, scheduling services, purchasing products, or communicating with us by telephone, email, or text message, you agree to these Terms of Service.

1. Our Services

Trees and Plants provides landscaping, lawn-care, garden-center, plant and tree, installation, maintenance, consultation, and related products and services.

The availability, scope, timing, and price of services may depend on factors such as:

  • The type and condition of the property.

  • The requested products or services.

  • Site access and working conditions.

  • Product, plant, material, and labor availability.

  • Weather and seasonal conditions.

  • Permit, utility, inspection, or third-party requirements.

Submitting a contact form, booking request, or quote request does not guarantee that we will accept or schedule the work.

2. Estimates, Proposals, and Changes

Any estimate or proposal is based on the information and property conditions known when it is prepared. Unless stated otherwise in writing, an estimate is not a guarantee of the final cost.

Pricing or scheduling may change when:

  • The requested scope of work changes.

  • Previously unknown property or site conditions are discovered.

  • Additional labor, products, materials, equipment, permits, or disposal services are required.

  • The customer requests additional work.

  • Supplier pricing or product availability changes.

We will communicate material changes and may require written approval before performing work outside the agreed scope.

An estimate or proposal may have an expiration date. After that date, pricing and availability may be subject to revision.

3. Scheduling and Access

Appointments and project dates are estimates unless we expressly confirm otherwise in writing. Schedules may be affected by weather, emergencies, staffing, material availability, site conditions, delays on earlier projects, or circumstances outside our reasonable control.

Customers are responsible for providing safe and reasonable access to the property at the scheduled time. This includes, when applicable:

  • Unlocking gates.

  • Securing pets.

  • Removing vehicles or personal property from the work area.

  • Identifying irrigation systems, invisible fences, private wiring, drainage systems, septic components, or other concealed improvements.

  • Obtaining permission from property owners, homeowners’ associations, or other responsible parties.

We are not responsible for delays caused by inaccessible or unsafe working conditions.

4. Utilities and Underground Property

Customers must disclose known private utilities and underground property that may not be identified through standard utility-location services. Examples include private electrical lines, irrigation lines, invisible pet fences, septic systems, drainage systems, landscape lighting wires, and privately installed piping. Trees and Plants is not responsible for damage to undisclosed or improperly marked private utilities or underground items, except where responsibility cannot legally be excluded.

5. Cancellations and Rescheduling

Please contact us as soon as possible when you need to cancel or reschedule an appointment.

Repeated cancellations, short-notice cancellations, denied property access, or missed appointments may result in:

  • Delayed rescheduling.

  • A cancellation or service-call charge when previously disclosed.

  • Loss of a deposit when permitted by the applicable proposal or agreement.

  • Suspension or termination of scheduled services.

Project-specific cancellation terms included in an accepted estimate, proposal, contract, or work order will control if they differ from this section.

6. Products, Plants, and Materials

Plant and material availability may change without notice. Plant size, shape, color, fullness, branching, and appearance naturally vary. Product photographs and descriptions are illustrative and may not exactly represent the individual product provided. We may recommend a reasonably comparable substitute when a selected plant or material becomes unavailable. We will seek customer approval before making a material substitution when reasonably practical. Customers purchasing plants or products directly from the garden center are responsible for transportation, installation, watering, maintenance, and care unless those services are included in a separate written agreement.

7. Plant Health and Customer Care

Plants are living products affected by watering, drainage, soil conditions, temperature, sunlight, pests, disease, wildlife, improper care, and extreme weather.

The customer is responsible for following watering and care instructions after installation or purchase. Unless expressly included in a written warranty, Trees and Plants does not guarantee plant survival when loss or damage results from:

  • Insufficient or excessive watering.

  • Irrigation failure.

  • Poor drainage or flooding.

  • Drought, freezing, heat, storms, or other extreme weather.

  • Animal or wildlife damage.

  • Disease, insects, herbicide exposure, or chemical damage.

  • Improper maintenance or care.

  • Actions taken by the customer or another contractor.

Any written plant or workmanship warranty included in a proposal, invoice, or contract will govern that project.

8. Payments

Payment terms will be stated in the applicable estimate, proposal, invoice, work order, or contract. Depending on the project, we may require a deposit, progress payments, payment when products are purchased, or payment upon completion. Customers agree to provide accurate billing information and make payments by the stated due dates. Past-due balances may be subject to collection costs, late charges, suspension of services, or other remedies disclosed in the applicable agreement and permitted by law. A payment dispute does not automatically cancel amounts owed for undisputed products or services.

9. Customer Communications

You agree that we may contact you using the contact information you provide for purposes related to your inquiry, account, estimate, purchase, appointment, project, services, invoice, or customer-support request.

You are responsible for keeping your telephone number, email address, service address, and billing information accurate and current.

10. Trees and Plants Text-Messaging Program

The messaging program is operated by Trees and Plants Landscaping Services. When you provide your mobile telephone number and consent to receive text messages, we may send messages concerning:

  • Quote and consultation requests.

  • Appointment confirmations and reminders.

  • Scheduling or rescheduling.

  • Service and project updates.

  • Weather-related delays.

  • Product, pickup, or delivery information.

  • Estimates, invoices, and payment reminders.

  • Responses to customer-support questions.

  • Follow-up communications.

  • Seasonal offers or promotional messages when you have consented to receive them.

Consent to receive marketing text messages is not a condition of purchasing products or services.

Message frequency

Message frequency varies depending on your requests, scheduled services, active projects, account activity, and communication preferences.

Charges

Message and data rates may apply. Your mobile carrier’s messaging and data charges are your responsibility.

Opting out

You may cancel text messages at any time by replying STOP.

After you send STOP, we may send one final message confirming that you have been unsubscribed. You will then no longer receive text messages from that messaging program unless you provide consent again.

Opting out of text messages does not prevent us from communicating with you through other appropriate methods regarding active services, transactions, safety issues, or legal obligations.

Supported carriers and delivery

Mobile carriers are not responsible for delayed or undelivered messages. Text-message delivery may be affected by your carrier, device, service availability, or other circumstances outside our control.

Privacy

Your participation in our text-messaging program is also governed by our Privacy Policy. On the published page, hyperlink the words “Privacy Policy” to your public privacy-policy page.

We do not sell, rent, or share mobile telephone numbers, text-message opt-in information, or text-message consent with third parties or affiliates for their marketing or promotional purposes.

11. Promotional Emails

You may unsubscribe from promotional emails by following the unsubscribe instructions included in the message.

Even after unsubscribing from promotional communications, we may continue to send non-promotional communications related to requested estimates, appointments, active projects, purchases, invoices, payments, warranties, or customer support.

12. Website Use

You agree not to use our website:

  • For unlawful, fraudulent, or abusive purposes.

  • To interfere with the website’s operation or security.

  • To introduce malware or harmful code.

  • To attempt unauthorized access to our systems or data.

  • To copy or exploit website content in violation of intellectual-property rights.

  • To submit false, misleading, or unauthorized requests.

We may restrict access to the website when reasonably necessary to protect our business, customers, systems, or legal rights.

13. Website Information

We work to keep website information accurate, but product availability, inventory, pricing, photographs, service descriptions, business hours, and other information may change.

Website content is provided for general information and does not replace a project-specific estimate, proposal, contract, product label, care instruction, or professional evaluation.

14. Intellectual Property

The website and its text, graphics, photographs, logos, branding, designs, and other original content are owned by or licensed to Trees and Plants and are protected by applicable intellectual-property laws.

You may view and use the website for personal, noncommercial purposes. You may not reproduce, distribute, sell, alter, or commercially exploit website content without prior written permission.

15. Third-Party Services and Links

Our website or communications may include links to or integrations with third-party websites and services, including scheduling, payment, mapping, social-media, or customer-management providers.

Those third parties operate under their own terms and privacy practices. We are not responsible for third-party websites or services that we do not control.

16. Disclaimer and Limitation of Liability

Services will be performed in accordance with the applicable written agreement and any warranties expressly included in that agreement.

To the fullest extent permitted by law, Trees and Plants will not be liable for indirect, incidental, special, exemplary, or consequential damages resulting from use of the website, delays, service interruptions, product availability, or circumstances outside our reasonable control.

Nothing in these Terms excludes or limits a right, warranty, duty, or liability that cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from:

  • False or unauthorized information you provide.

  • Your misuse of our website or services.

  • Unsafe conditions under your control.

  • Your violation of these Terms or applicable law.

This section does not require you to indemnify Trees and Plants for responsibility that cannot legally be transferred to you.

18. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any project-specific agreement may include additional dispute-resolution or venue terms. When a separate written agreement conflicts with these general website Terms, the project-specific agreement will control for that project.

19. Changes to These Terms

We may update these Terms periodically to reflect changes in our services, communication practices, technology, or legal obligations. The revised Terms will be posted on this page with an updated effective date. Continued use of the website or services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
